Privacy Policy

1. Purpose

1.1 The purpose of the Fuller Life Therapy Services Privacy Policy (hereinafter referred to as “the Privacy Policy”) is to explain to you how Fuller Life Therapy Services uses, collects and manages all personal information, including but not limited to your health information from patients and the circumstances in which Fuller Life Therapy Services may share such information with third parties.

1.2 The Privacy Act was significantly amended in 2014 by the Privacy Amendment (Enhancing Privacy Protection) Act 2012 and with effect from 22 February 2018, further amendments require Fuller Life Therapy Services to report eligible data breaches that are likely to cause serious harm.

1.3 Fuller Life Therapy Services is a health service provider, and we are required to comply and abide with the Australian Privacy Principles (hereinafter referred to as “APP”) which have been enacted in accordance with the Privacy Act 1988 (hereinafter referred to as the “Privacy Act”).

1.4 The APP regulates how Fuller Life Therapy Services may collect, use, disclose, divulge and store your personal and health information which we retain with regards to patients.


2. Important Defined Terms

2.1 In this Privacy Policy, Fuller Life Therapy Services adopts the definitions in Section 6 of the Privacy Act, as amended from time to time.

Personal Information means all information and opinion about an identified individual, or an individual who is reasonably identifiable:
• whether the information is true or not; and
• whether the information is recorded in a material form or not.

Health Information means all information and opinion about:
• the health or disability of an individual;
• an individual’s expressed wishes about future health services;
• a health service provided or to be provided; or
• other personal information collected to provide a health service.

Sensitive Information includes information about:
• racial or ethnic origin
• political opinions
• religious or philosophical beliefs
• membership of political, professional or trade associations or unions
• sexual orientation or practices
• criminal record
• genetic or biometric information
• health information.

2.2 Reference to personal and health information is a collective reference to all of the above.


3. Patient Anonymity and Pseudonymity

3.1 Where lawful and practicable, clients may deal with Fuller Life Therapy Services anonymously or by pseudonym, such as when making general enquiries.


4. Why We Collect, Use, Hold and Share Information

4.1 We collect personal and health information to:

• provide health care services.
• contact clients regarding services.
• administer and manage services including billing; and
• comply with Australian legislation.


5. Types of Information We Collect

5.1 We may collect information from third parties including parents, guardians, health professionals, referrers, and authorised representatives.

5.2 Information may include:
• name, date of birth, gender
• address, email, phone
• occupation
• Medicare and referrer details
• relevant health information.

5.3 Sensitive Information is only collected with consent or when required by law.


6. How We Hold Your Information

6.1 Information is stored in hard copy and electronic systems including SPLOSE.

6.2 Use and Disclosure Relating to AI

You acknowledge that:
• some services may use AI technologies powered by OpenAI LLC;
• to optimise AI features, de-identified or consented data may be transmitted outside Australia;
• you consent to this processing;
• you may withdraw consent at any time.


7. How We Use Your Information

7.1 We use information for:
• continuity of care
• treatment advice
• communication with carers
• compliance and funding
• audits, billing, legal defence, research, and quality assurance.

Independent Contractors

7.2 Contractors must comply with this policy.


Direct Marketing and Research

7.3 Used only with prior consent.


7A. Use of Artificial Intelligence (AI) in Sessions

7A.1 We may use closed-ended AI systems to support therapy and operations.

7A.1(a) Example: Everbility, which is APP and HIPAA compliant.

7A.2 We ensure:
• no identifiable data without consent
• clinician supervision
• AI supports, not replaces, clinical judgement.

7A.3 We do not use open AI platforms (e.g. ChatGPT, Copilot) for identifiable client data.

7A.4 All AI prompts are de-identified unless consent is provided.

7A.5 Clients may request non-AI alternatives.

7A.6 Use will cease if compliance standards are not met.


8. Access and Correction

Clients may access, amend, or annotate records subject to APP exceptions. Fees may apply.


9. Data Quality

We ensure information is accurate, current, complete and relevant.


10. Data Security

We protect data from misuse and de-identify or destroy when no longer required.


11. Identifiers

We assign internal identifiers and may collect Medicare or health fund numbers.


12. International Disclosure

We may disclose information overseas only where privacy protections are substantially similar.
